Terms of Service

1. Acceptance of terms
By downloading, installing, or using the Circus application or any related service (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
These Terms form a contract between you and Circus Corporation (“Circus”, “we”, “us”). References to “you” mean the individual or entity using the Service.
2. Eligibility
You must meet the minimum age requirement to use Circus. In most countries this is 16 years old; in some regions it is 18. In countries where the minimum age of digital consent is lower, we apply the higher of 16 or the local legal minimum. If you are under 18, you confirm that you have parental or guardian consent. By using the Service, you represent that you meet these age requirements.
You must provide accurate information when creating your account. You are responsible for maintaining the security of your account credentials.
3. Your account
You are responsible for all activity that occurs under your account. Do not share your password or allow others to access your account.
You may not create an account if you have previously been banned from Circus. You may not impersonate another person or create an account using false information.
4. Content and conduct
You retain ownership of content you post on Circus. By posting content, you grant Circus a worldwide, non-exclusive, royalty-free license to display, distribute, and promote that content in connection with operating the Service.
You are solely responsible for the content you post. You agree not to post content that:
- Violates any applicable law or regulation
- Infringes the intellectual property rights of any third party
- Contains sexual content involving minors (CSAM) — this is strictly prohibited and will be reported to law enforcement
- Constitutes harassment, threats, or targeted abuse of any person
- Is deliberately false and designed to deceive
- Contains malware, spam, or unsolicited commercial content
Circus may remove content that violates these Terms and may suspend or terminate accounts that repeatedly or seriously violate them.
5. Creator accounts and payments
Creators who offer paid content or memberships through Circus agree to our separate Creator Agreement, which governs payouts, tax obligations, and content standards for monetized accounts.
Circus uses a third-party payment processor to process payments. By enabling paid features, you agree to the payment processor’s terms of service in addition to these Terms.
All fees and revenue splits are as described in the Creator Agreement. Circus reserves the right to modify fees with 30 days’ notice to affected creators.
6. Intellectual property
The Circus name, logo, and all related trademarks are the property of Circus Corporation. Nothing in these Terms grants you a right to use our trademarks without our prior written permission.
The Circus application and its underlying technology are protected by copyright and other intellectual property laws. You may not copy, reverse-engineer, or create derivative works from any part of the Service.
7. Privacy
Our collection and use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Third-party services
The Service may integrate with or link to third-party services (including Apple and Google). Your use of those services is subject to their own terms and privacy policies. Circus is not responsible for third-party services.
9. Disclaimers and limitation of liability
The Service is provided “as is” without warranty of any kind. To the fullest extent permitted by law, Circus disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement.
To the fullest extent permitted by law, Circus will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
10. Termination
You may stop using Circus at any time and delete your account from the app settings. We may suspend or terminate your account if you violate these Terms, or for any reason with reasonable notice.
On termination, your right to use the Service ends immediately. Sections 4, 6, 9, 11, and 12 survive termination.
11. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles, subject to any mandatory local consumer protection laws that may apply in your jurisdiction.
11a. Informal resolution
Before either party may initiate formal legal proceedings (other than to seek emergency injunctive relief), the disputing party must send written notice to legal@circus.app describing the dispute and the remedy sought. The parties will attempt to resolve the dispute informally for 30 days from the date of notice. If the dispute is not resolved within that period, either party may pursue the remedies below.
11b. Binding arbitration
Disputes not resolved informally will be settled by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, conducted in Wilmington, Delaware, or virtually by mutual agreement. The arbitrator has authority to award any remedy a court could award. Each party bears its own costs and attorneys’ fees; for claims under $10,000 where you are the claimant, Circus will pay the JAMS filing fee. The arbitrator’s decision is final and may be entered as a judgment in any court of competent jurisdiction. Nothing in this section limits either party from seeking emergency relief in a court of law.
11c. Class action waiver
To the fullest extent permitted by applicable law, all disputes must be resolved on an individual basis. You may not bring a claim as a plaintiff or class member in any class, collective, consolidated, or representative action. If this waiver is held unenforceable as to a particular claim, the arbitration clause in 11b shall not apply to that claim, which shall then be resolved in the courts of Delaware.
12. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes via in-app notification at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
